General terms and conditions of business

The following general terms and conditions (hereinafter referred to as "GTC") apply to all contracts concluded with OUTRYGHT eU, located at Laudongasse 22 I Top X/XI, 1080 Vienna, Austria (hereinafter referred to as "Outryght") for goods purchased online, by telephone or in writing.

By using the website, the customer enters into a business relationship with Outryght, thereby acknowledging these Terms and Conditions as the basis for the entire business relationship between the customer and Outryght. Any differing terms and conditions stipulated by the customer or any modifications to these Terms and Conditions by the customer are invalid unless Outryght's management expressly agrees to them in writing. Actions taken by Outryght to fulfill the contract do not constitute acceptance of any terms and conditions that deviate from Outryght's Terms and Conditions.

1. CONCLUSION OF CONTRACT

The goods and information displayed on the Outryght website or in the Outryght catalogs are for informational purposes only and do not constitute a binding offer to sell. Clicking the "buy" button places a binding and irrevocable order for the goods in your shopping cart. Confirmation of receipt of your order via an automated email does not yet constitute acceptance of your order. Acceptance of your order only occurs upon receipt of an order confirmation or shipping confirmation sent via email. Outryght reserves the right to reject any order within 7 business days – even without stating a reason.

If Outright cannot accept the customer's offer or if certain products in the order are no longer available, the customer will be informed as soon as possible.

Outright is not responsible for typographical, printing, or calculation errors on the website or in the product catalog. 

All offers are valid while stocks last.

If Outright does not accept an order, any purchase price already paid will be refunded within 15 working days or, at the customer's request, credited towards other goods.

The customer has a right of withdrawal within 14 calendar days in accordance with Section 11 Paragraph 1 FAGG, calculated from the day of the order.

2. INFORMATION ON THE RIGHT OF WITHDRAWAL

The order can be cancelled up to 14 calendar days after placing it. To meet the cancellation deadline, it is sufficient to send the cancellation notice by email in a timely manner. If delivery has already been made, the goods must also be returned in a timely manner.

The right to withdraw from the contract and receive a full refund of the purchase price applies only to products returned in the same condition as delivered. The goods must not be worn or otherwise used. Only an inspection of the product's characteristics and functionality, as is possible and customary in a retail store, is permitted.

In addition to the item itself, all labels, tags, product instructions, and packaging must also be returned. If this is not the case, or if the item has been used, worn, or washed, OUTRYGHT may refuse the refund or reduce the refunded purchase price.

In the event of a valid cancellation, both parties must return any payments or services received. Outryght will refund the purchase price within 21 business days of receiving the returned goods, provided the customer has supplied their bank details; payment by mail is not accepted. If Outryght objects to the cancellation, the customer will receive written notification. Refunds will be issued less any applicable deduction for defects or missing parts. Outryght reserves the right not to refund the purchase price for returned goods that are not suitable for resale.

3. Return shipping costs

The buyer is responsible for returns and bears the costs. The notice of cancellation should be addressed to, or the goods should be sent to, the following address:

EXCHANGE

If the customer is not satisfied with the ordered items, they can return them within 14 calendar days of receiving the order. If the ordered goods do not fit and the customer wishes to exchange them for a different size or color, a new order for the desired product must be placed.

DELIVERY

Unless otherwise agreed, delivery will be made to the delivery address specified by the customer. Delivery is made via DPD at the customer's expense.

4. DUE DATE AND PAYMENT, DEFAULT

All prices are in euros, with VAT shown separately. Prices are valid at the time of ordering and remain valid until further notice.

For cross-border deliveries, any taxes and/or duties (e.g., customs duties) and/or other expenses incurred are payable by the buyer as per the separate invoice.

Shipping costs are calculated based on the invoice amount. 

The purchase price is due immediately upon ordering without any deductions.

The customer can pay the purchase price by credit card (Visa, Mastercard), PayPal, Amazon Pay, and instant bank transfer. For instant bank transfers, the order is only valid once the amount has been credited to OUTRYGHT's account. 

OUTRYGHT reserves the right to pledge or assign your outstanding purchase price claims arising in connection with deliveries of goods to third parties.

5. SHIPPING COSTS

Depending on the order total and the delivery country, shipping costs may apply; these will be shown separately during the ordering process. The buyer is responsible for returns and any associated costs.

6. SET-OFF, RETENTION

The customer is only entitled to set-off if their counterclaims have been legally established or acknowledged by Outryght. The customer is only entitled to exercise a right of retention to the extent that a legally established counterclaim or one acknowledged by Outryght arises from the same contractual relationship.

7. RETENTION OF TITLE

The goods remain the property of Outright until full payment is received.

8. WARRANTY

Outright adheres to the statutory warranty regulations in Austria in the event of defects in the goods. 

Obvious transport, material or manufacturing defects must be reported immediately.

The warranty does not cover normal wear and tear. Nor does it cover fashionable effects such as a "vintage look".

If the purchased item has a defect for which Outryght is responsible, Outryght is entitled, at its own discretion, to remedy the defect or provide a replacement. If Outryght is unwilling or unable to remedy the defect or provide a replacement, or if this is delayed beyond a reasonable period for reasons attributable to Outryght, or if the remedy or replacement otherwise fails, the customer is entitled, at their discretion, to withdraw from the contract or demand a corresponding reduction in the purchase price.

If a warranty claim arises with a product purchased in the online shop, the customer can return the goods to the specified contact address. If it turns out that there is no defect covered by the warranty, Outright will charge the customer for the incurred expenses by deducting a corresponding amount from any refundable purchase price.

Compensation for consequential damages (due to defects), as well as other property damage, financial losses and damages to third parties against the customer (unless this is a consumer transaction) is excluded.

9. IMAGE RIGHTS

All rights to the online images, logos, and other visuals belong to Outryght. Use without the express written permission of Outryght is prohibited. Commercial use of the images, logos, or similar materials entitles Outryght to a usage fee, which must be agreed upon in advance on a case-by-case basis.

11. OTHER

For the sake of readability, we have refrained from using the simultaneous forms of masculine, feminine, and diverse (m/f/d). All designations/terms apply equally to all genders.

Should one or more provisions of these Terms and Conditions be or become invalid or unenforceable, they shall not apply. This shall not affect the validity and enforceability of all other provisions. In place of the inapplicable provisions, the provision that most closely reflects the content and meaning of the valid provisions of these Terms and Conditions shall apply. This also applies analogously to any gaps in these Terms and Conditions.

All agreements between customers and OUTRYGHT are only valid in written form (including email); verbal side agreements are excluded or invalid unless subsequently confirmed in writing by both parties (also possible via email or via the internet/chat on the OUTRYGHT homepage).

The place of performance for business transactions is the registered office of Outryght. For any legal disputes arising from this contractual relationship, the exclusive subject-matter and territorial jurisdiction of the District Court for Commercial Matters in Vienna is agreed upon, unless the transaction is a consumer transaction within the meaning of the Consumer Protection Act.
